1. Acceptance of Terms
Welcome to Bibliotheca. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Bibliotheca ("we," "us," "our," or "Company") governing your access to and use of the Bibliotheca mobile application ("App") and all related services (collectively, the "Service").
BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
You must be at least 13 years of age (or 16 in certain jurisdictions) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. Description of Service
2.1 Core Features
Bibliotheca is a personal reading tracker application that allows you to:
- Catalog and organize your personal book library
- Track reading progress, sessions, and completion
- Set and monitor reading goals
- Maintain reading statistics and streaks
- Search for books using integrated book databases
- Rate and review books you have read
- Create custom bookshelves and collections
2.2 Social Features
The Service includes optional social features that allow you to:
- Connect with friends and view their reading activity
- Pair with a reading buddy for mutual accountability
- Join or create reading circles (premium feature)
- Participate in reading challenges (premium feature)
- Send and receive book recommendations
- Send book gifts to friends (premium feature)
- Share reading updates to Discord (premium feature)
2.3 Guest Mode
You may use the App in Guest Mode without creating an account. Guest Mode stores all data locally on your device. Guest Mode data is not synced across devices and cannot be recovered if the App is deleted or your device is lost.
3. User Accounts
3.1 Account Creation
To access cloud sync and social features, you must create an account using email/password, Apple Sign In, or Google Sign In. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password for your account
- Notify us immediately of any unauthorized access or security breach
- Not share your account credentials with others
- Not allow others to access your account
3.3 Account Termination by User
You may delete your account at any time through Settings > Account > Delete Account. Upon deletion, your data will be permanently removed from our servers within 30 days, except as required by law or for legitimate business purposes.
4. Subscription and Payment Terms
4.1 Free and Premium Tiers
Bibliotheca offers both free and premium subscription tiers:
- Free Tier: Core reading tracking features, basic social features, limited shelves
- Premium Tier: All features including reading circles, challenges, book gifts, AI recommendations, Discord integration, advanced stats, Year in Review, unlimited shelves, and data export
4.2 Subscription Plans
Premium subscriptions are available as monthly or annual subscriptions. Actual prices are displayed in the App and may vary by region. All prices are subject to change with reasonable notice.
4.3 Payment Processing
All payments are processed through Apple App Store or Google Play Store, depending on your device platform. By subscribing, you also agree to the payment terms of the applicable app store.
4.4 Automatic Renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.
4.5 Refunds
Refund requests must be made through Apple App Store or Google Play Store, as applicable. We do not directly process refunds. Refund policies are subject to the terms of the respective app stores.
5. User Content and Conduct
5.1 Your Content
"User Content" means any content you submit, post, or transmit through the Service, including book notes, reviews, custom entries, messages, and profile information. You retain ownership of your User Content.
5.2 License Grant
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and transmit your User Content solely for the purpose of operating and providing the Service to you. This license terminates when you delete your User Content or account.
5.3 Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations
- Posting illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
- Impersonating another person or misrepresenting your affiliation
- Accessing or attempting to access other users' accounts or data
- Interfering with or disrupting the Service or servers
- Transmitting viruses, malware, or other harmful code
- Using the Service for unauthorized commercial purposes or spam
- Attempting to reverse engineer, decompile, or extract source code
- Using automated means (bots, scrapers) to access the Service
- Harassing, bullying, or threatening other users
5.4 Content Moderation
We reserve the right, but not the obligation, to monitor, edit, or remove any User Content that we determine violates these Terms or is otherwise objectionable. We may also suspend or terminate accounts that violate these Terms.
6. Third-Party Services and Content
6.1 Book Data
Book metadata (titles, authors, descriptions, covers, ISBNs, page counts) is sourced from third-party APIs including Google Books API and Open Library API. This data is provided "as is" and we make no guarantees regarding its accuracy, completeness, or availability.
6.2 Affiliate Links
The Service may include links to third-party book retailers such as Amazon, Bookshop.org, and Apple Books. These are affiliate links, meaning we may earn a small commission when you make a purchase through them. This commission comes from the retailer and does not affect the price you pay.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its design, features, functionality, graphics, logos, and software, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
7.2 Trademarks
"Bibliotheca" and associated logos are trademarks of Bibliotheca. You may not use our trademarks without prior written consent.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability.
We do not warrant that: (a) the Service will meet your requirements; (b) the Service will be available at all times; (c) any defects will be corrected; or (d) book data from third-party sources will be accurate.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall Bibliotheca, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses.
In no event shall our total liability to you for all claims exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim; or (b) one hundred dollars ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Bibliotheca and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.
11. Termination
11.1 Termination by You
You may terminate your account at any time by deleting your account through the App settings or by discontinuing use of the Service.
11.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms, conduct harmful to other users, fraudulent or illegal activity, or extended period of inactivity.
11.3 Forfeiture Upon Termination for Cause
If your account is terminated by us due to violation of these Terms, any active paid subscription will be immediately cancelled with no refund for the remaining subscription period, and any unused credits or promotional access will be permanently forfeited.
12. Dispute Resolution
12.1 Informal Resolution
Before filing any formal legal claim, you agree to first contact us at contact@wolpertinger.org and attempt to resolve the dispute informally for at least 30 days.
12.2 Binding Arbitration
If we cannot resolve a dispute informally, you and Bibliotheca agree to resolve any claims through binding arbitration, rather than in court, except you may assert individual claims in small claims court if they qualify.
12.3 Class Action Waiver
YOU AND BIBLIOTHECA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and provide notice through the App. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bibliotheca regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
